Terms of Service

1. Who we are

Mockingbird is a service operated by Sancar Media. References to "Mockingbird", "we", "us" and "our" mean Sancar Media. References to "you" and "your" mean the person or organisation using the service.

By creating an account, paying a trial fee, or otherwise using the service, you agree to be bound by these Terms.

2. What Mockingbird does

Mockingbird takes hand-curated reference advertisements from public sources (including the Meta Ad Library) and remakes them in your brand voice using your own product photos, colour palette and copy. We do not reproduce the original advertisement's creative. We use the reference as a structural prompt for an AI image generator that creates a new image based on your brand inputs.

3. Accounts

You must provide accurate sign-up information and keep your login credentials confidential. You are responsible for all activity on your account. You must be at least 18 years old to use Mockingbird.

We may suspend or terminate accounts that violate these Terms, attempt to circumvent the trial mechanism, abuse the platform, or use the service to produce content that is unlawful or infringes third-party rights.

4. Billing, trial and cancellation

  • The $5 trial fee is charged immediately on subscription and is non-refundable.
  • Three days after the trial fee is charged, we automatically charge the full monthly or annual plan price unless you cancel from the Billing section of your account before that point.
  • After conversion, plans renew on a recurring monthly or annual cycle. You can cancel at any time and your plan will end at the end of the current period.
  • Cancelling does not retroactively refund the current period. Already-generated ads remain yours.
  • Card declines move your account to a past-due state. You can update your card via the Stripe Customer Portal accessible from Billing.
  • Refunds outside of these terms are at our discretion. Email hello@mockingbirdhouse.com if you have a dispute.

5. Ad credits

Every remake and every revision that you initiate consumes one ad credit from your plan's monthly quota. Credits do not roll over month to month. Credits are not transferable between brands on the same account.

Pipeline failures caused by our service (infrastructure outages, model errors that we attribute to our own pipeline) do not consume a credit. Failures caused by user inputs (banned content, missing assets, prompt violations) do consume a credit.

6. Your content and our content

You retain all rights to the brand inputs you provide (website, product photos, logo, brand voice). You grant Mockingbird a worldwide, royalty-free licence to use those inputs solely for the purpose of operating the service for you, including transmitting them to our model providers (OpenAI and Anthropic) as part of the remake pipeline.

You own the output ads we deliver to you. You may use them commercially, including in paid Meta advertising campaigns, for the duration of your subscription. If you cancel, the ads already delivered remain yours to use.

You are responsible for ensuring the brand assets you submit are yours to submit. You must have rights to any logos, product photos, trademarks and copy you upload.

7. Acceptable use

You agree not to use Mockingbird to:

  • Generate content that infringes third-party intellectual property
  • Impersonate other brands, including by uploading their logos or product photos as if they were yours
  • Produce content that is illegal, defamatory, discriminatory, sexually explicit, or that targets minors
  • Reverse engineer, scrape, or republish our library
  • Create multiple accounts to repeatedly claim the $5 trial
  • Attempt to bypass our credit, brand or rate limits

8. Service availability

We aim for high uptime but the service is provided "as is". We rely on third-party providers (Supabase, Vercel, Stripe, OpenAI, Anthropic, Inngest) and outages on their side may affect availability. We are not liable for losses caused by downtime, model degradation, or third-party provider failure.

9. Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of Mockingbird is limited to the amount you paid us in the twelve months prior to the claim. We are not liable for indirect, consequential, or incidental damages.

10. Changes to these Terms

We may update these Terms from time to time. We'll email you about material changes. Continued use of the service after an update means you accept the new Terms.

11. Governing law

These Terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
